“The powers delegated by the proposed Constitution to the federal government, are few and defined.
Those which are to remain in the State governments are numerous and indefinite.”
-James Madison, Federalist 45, January 26, 1788
James Madison’s above line from Federalist Papers Number 45 articulates a truth too many have forgotten; The US is a republic where the federal government and the states share sovereign authority. The debate has always been at what point exactly does the federal reach end and state begin? Let this debate continue. The side of federalism ought to prevail.
The 10th Amendment reads-
“The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”
Before that wonderful Amendment was added, the Father of Constitution explained in Federalist 45 that the federal government will have “few and define” powers and the states and the people get the rest.
This is very important in today’s context. The overreach of both the Biden Administration and Democrats in Congress have ignored the facts of the 10th Amendment and the explanation from its principal author.
